These Terms of Use (“Terms”) govern your access to and use of the website, products, content, reports, diagnostics, assessments, software, templates, communications, and services provided by SKIN Ventureworks Inc. (“SKIN,” “we,” “us,” or “our”), including Fundable, Pulse, SKIN OS, ATLAS, Field Notes, founder diagnostics, investor-readiness reports, company health assessments, startup operating frameworks, and related offerings.

By accessing the website, purchasing a product, subscribing to a service, submitting information, or otherwise using SKIN, you agree to these Terms. If you do not agree, do not use the website or services.

Important: SKIN provides startup intelligence and strategic tools. SKIN is not a law firm, accounting firm, broker-dealer, investment adviser, fundraising agent, or financial advisor.

1. About SKIN

SKIN provides startup intelligence products and services for founders and startup teams. SKIN helps users understand what is broken, what to prioritize, and how to build with better judgment through diagnostics, company health assessments, investor-readiness analysis, reports, frameworks, and related strategic tools.

2. Eligibility

You must be at least 18 years old to use SKIN. If you use SKIN on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

3. No Professional Advice

SKIN services, reports, diagnostics, scores, recommendations, frameworks, and outputs are for informational, educational, and internal business purposes only.

Nothing provided by SKIN should be interpreted as legal, tax, accounting, securities, investment, financial, or fundraising advice. You are responsible for making your own business decisions and consulting qualified professionals where appropriate.

4. No Guarantee of Results

SKIN may provide scores, diagnostics, recommendations, investor-readiness analysis, company health signals, prioritization frameworks, or other outputs. These outputs are directional and judgment-based.

SKIN does not guarantee that you will raise capital, secure investor meetings, obtain customers, improve performance, increase revenue, receive investment, avoid business failure, or achieve any specific business outcome.

5. Products, Purchases, Subscriptions, and Billing

SKIN may offer one-time products, subscriptions, trials, discounted offers, custom services, advisory services, or enterprise products. Product descriptions and pricing may change at any time.

Payments may be processed by third-party providers such as Stripe. By purchasing a product or subscription, you agree to provide accurate billing information and authorize the applicable charges.

Subscriptions renew automatically unless canceled before the next billing period. You are responsible for managing cancellations through the available billing flow or by contacting us at dom@skin.global.

Unless otherwise stated in writing or required by law, payments are non-refundable once a digital product has been delivered, a report has been generated, work has started, or a subscription period has begun.

6. Submitted Materials

You may submit startup materials, founder information, pitch decks, business descriptions, financial assumptions, traction data, fundraising information, customer information, product information, or other company materials.

You retain ownership of your submitted materials. You grant SKIN a limited, worldwide, non-exclusive, royalty-free license to use, host, process, reproduce, modify, analyze, and display submitted materials solely as reasonably necessary to provide, operate, improve, support, and develop SKIN products and services.

You represent and warrant that your submitted materials are accurate to the best of your knowledge, that you have the right to submit them, and that they do not violate any law, contract, confidentiality obligation, intellectual property right, privacy right, or other third-party right.

7. Confidentiality

SKIN takes founder and company information seriously and uses reasonable safeguards to protect submitted materials. However, unless SKIN has signed a separate written NDA or confidentiality agreement with you, your submission is governed by these Terms and our Privacy Policy.

Do not submit highly sensitive, regulated, classified, or confidential third-party information unless you are authorized to do so.

8. AI, Automation, and Generated Outputs

SKIN may use artificial intelligence, automation, structured frameworks, data models, internal review processes, and third-party technology providers to analyze information and generate reports, diagnostics, scores, recommendations, prioritization frameworks, company health signals, investor-readiness analysis, and other outputs.

You understand that AI-assisted and automated outputs may be incomplete, inaccurate, or not suitable for your specific circumstances. You are responsible for independently reviewing and validating any output before relying on it or sharing it with third parties.

9. Acceptable Use

You agree not to:

  • Use SKIN for unlawful, fraudulent, deceptive, harmful, or abusive purposes.
  • Submit false, misleading, incomplete, or fraudulent company, founder, financial, traction, fundraising, or investor information.
  • Use SKIN reports, diagnostics, scores, or outputs to mislead investors, customers, partners, advisors, or other third parties.
  • Upload or submit confidential, proprietary, or third-party information that you do not have the legal right or authorization to share.
  • Reverse engineer, copy, scrape, resell, white-label, or create derivative products from SKIN frameworks, reports, diagnostics, scoring systems, templates, or product outputs.
  • Use the services as a substitute for professional legal, financial, tax, accounting, securities, investment, or fundraising advice.
  • Attempt to access, test, interfere with, or compromise SKIN systems, accounts, data, infrastructure, or security controls.
  • Upload malicious code, spam, malware, or harmful content.
  • Use bots, crawlers, scrapers, or automated systems to access SKIN without written permission.
  • Sell, transfer, sublicense, or otherwise commercially exploit your account or access to SKIN without written permission.

10. Intellectual Property

The SKIN name, logos, brand, website, product names, frameworks, diagnostics, scoring systems, report formats, templates, designs, content, software, data structures, workflows, and related materials are owned by SKIN or its licensors.

Subject to your compliance with these Terms, SKIN grants you a limited, revocable, non-exclusive, non-transferable license to access and use SKIN services and outputs for your own internal business purposes.

You may not resell, reproduce, publicly distribute, white-label, train competing models on, or create derivative products from SKIN materials without prior written permission.

11. Feedback

If you provide feedback, suggestions, ideas, or recommendations to SKIN, you grant SKIN the right to use that feedback without restriction or compensation to you.

12. Third-Party Services and Links

SKIN may link to or integrate with third-party services such as payment processors, document-sharing tools, newsletter platforms, analytics providers, hosting providers, or other vendors. We are not responsible for third-party websites, services, policies, security, availability, or practices. Your use of third-party services may be governed by their own terms and privacy policies.

13. Website Content and Field Notes

SKIN may publish articles, guides, commentary, templates, frameworks, and educational content. This content is for general informational purposes only and may not apply to your specific situation. We may update, change, or remove content at any time.

14. Privacy

Your use of SKIN is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect information.

15. Disclaimers

SKIN services are provided “as is” and “as available.” To the fullest extent permitted by law, SKIN disclaims all warranties of any kind, whether express, implied, or statutory, including warranties of accuracy, completeness, reliability, merchantability, fitness for a particular purpose, title, non-infringement, availability, and security.

We do not warrant that SKIN services will be uninterrupted, error-free, secure, current, complete, or free from harmful components.

16. Limitation of Liability

To the fullest extent permitted by law, SKIN and its officers, directors, employees, contractors, advisors, affiliates, and agents will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost revenue, lost data, lost business opportunities, lost fundraising opportunities, reputational harm, or business interruption.

To the fullest extent permitted by law, SKIN’s total liability for any claim will not exceed the amount you paid to SKIN for the product or service giving rise to the claim during the three months before the claim arose.

17. Indemnification

You agree to defend, indemnify, and hold harmless SKIN and its officers, directors, employees, contractors, advisors, affiliates, and agents from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of SKIN, your submitted materials, your violation of these Terms, your violation of law, or your violation of third-party rights.

18. Termination

We may suspend or terminate your access to SKIN at any time if we believe you have violated these Terms, created risk for SKIN or others, failed to pay amounts owed, or used the services in a way that may harm SKIN, users, partners, or third parties.

19. Changes to Services

We may modify, suspend, discontinue, replace, or limit any part of the website, products, features, pricing, or services at any time.

20. Dispute Resolution

Before filing any claim, you agree to first contact SKIN at dom@skin.global and attempt to resolve the dispute informally for at least 30 days.

If the dispute cannot be resolved informally, the dispute will be resolved by binding arbitration, except where prohibited by law or where either party seeks injunctive or equitable relief for intellectual property misuse, unauthorized access, or confidentiality violations.

Any arbitration or court proceeding will take place in Los Angeles County, California, unless applicable law requires otherwise. You and SKIN waive the right to participate in a class action, class arbitration, or representative proceeding to the fullest extent permitted by law.

21. Time Limit to Bring Claims

To the fullest extent permitted by law, any claim arising out of or related to these Terms or SKIN services must be brought within one year after the event giving rise to the claim. Claims filed after that period are permanently barred.

22. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.

23. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Your continued use of SKIN after an update means you accept the updated Terms.
